BENGAL KITTEN PURCHASE CONTRACT

This contract is between Wendy Pergentile of Calgary, Alberta, conducting business as BENGAL EXOTIC FX cattery, hereafter called Breeder, and __________ of ___________, hereafter called the Buyer.
This contract and agreement concerns the Bengal Kitten described below:

Terms of Sale: Buyer has purchased the above kitten for the amount __________ dollars $ _____, plus $ _____ GST for a total of $ _______ (if one of a two kitten purchase – contract will read – hereby reduced by one hundred $100.00 due to second kitten selection policy to $ _______, plus $ ______ GST for a total of $ ________) as purchase price for the above kitten, hereafter referred to as the Kitten, paid by _____, on __________ in full. Buyer will take possession of the Kitten on ________. The above total purchase price includes all required shots, spay or neuter, and microchip.
1. Breeder guarantees that the Kitten is a purebred Bengal cat, with an accurate
pedigree, and is eligible for individual registration in TICA - THE INTERNATIONAL
CAT ASSOCIATION, INC. This Breeder does provide papers. Any unintentional
delay by Breeder to provide Kitten’s registration blue slip within a
reasonable amount of time does not warrant a complaint being filed against
Breeder and communication is paramount.
2. Breeder further guarantees that this Kitten is free from any known life or health threatening genetic (1) defects, congenital (2) defects or diseases, is negative for FeLV and FIV and has been dewormed with first vaccines at 8 weeks of age and boosted with a second vaccine shortly thereafter. At the time of leaving the cattery, the Kitten is in good health unless otherwise specified herein, and has been vaccinated, therefore immunized against feline viral diseases, free of parasites, and of a stable, very affectionate temperament. Breeder is not liable for the effects of errors and/or mishandling on the part of the Buyer.
3. It is clearly understood that when purchasing any animal it is a living creature and governed first by nature, second by its environment, and third by the ethics of the Breeder of that animal and in that logical order. By nature and environment, for animals as well as human beings, things can indeterminately go wrong (congenital (2)), and that Breeder is not to be held responsible or condemned for things that are the result of occurrences by either nature or environment once the animal leaves the Cattery. A Breeder cannot rule over natural phenomena, only provide disclosure on what is known about established optimum health of any animal.
However, that being said, Breeder offers to still provide written guarantee which accommodates replacement of Kitten (not refund) should an event of this nature occur as stipulated below. Realistically individual minor idiosyncrasies, in both animals and humans are common, and there is no denying that. Things can and do happen, and it is not just cause for animosity against the Breeder or Cattery.
4. This kitten comes with its immunization and microchip records, and is guaranteed to the best of the Breeder’s knowledge to be in good health, unless other special circumstances have been noted, herein. For Buyer’s added protection, assurance and confidence, Breeder recommends, and it is the Buyer’s financial responsibility, to have the Kitten seen by a licensed veterinarian for a thorough examination within 72 hours after the kitten is received. If the veterinarian discovers that the Kitten is not as herein guaranteed, the Buyer must contact the Breeder immediately and provide a written explanation from the Buyer’s veterinarian as to any illness that has been determined.
5. If during the above veterinary examination it is determined the kitten cannot be cured, Kitten must be returned to Breeder, and the Breeder will replace, not refund, the Kitten with one of comparable quality and value as soon as a kitten of that colour and pattern is available. Any further shipping costs are the responsibility of the Buyer. From possession forward, it is the responsibility of the Buyer at the Buyer’s expense to provide immediate veterinary care to the Kitten showing any signs of illness or distress and failure to do so will render any health guarantee and Kitten replacement null and void.
6. Under no circumstances is the Kitten to be euthanized or destroyed prior to notification by the Buyer to the Breeder and reasons given.
7. Breeder guarantees Kitten against genetic or congenital defect for an additional two years from purchase date. If the Kitten dies within that time frame, despite medical treatment provided by Buyer’s veterinarian and at Buyer’s expense, Kitten replacement will be made ONLY if a full laboratory pathological necropsy is provided by Buyer that confirms cause of death and that the cause falls within what Breeder Guarantees and rules out other cause. Provision of required necropsy is the responsibility of the Buyer at the Buyer’s expense. Should Kitten be diagnosed with a genetic or congenital defect within the guarantee time frame of two years from purchase date, Kitten may be returned to Breeder along with all veterinary records that include record of all exams, vaccinations, treatments, lab reports and diagnosis provided by Buyer’s veterinarian at Buyer’s expense for historical and verification purposes, and Kitten will be replaced, not refunded, with a kitten of comparable quality and value as soon as a kitten of that colour and pattern is available. Any further shipping costs are the responsibility of the Buyer.
8. DECLARATION AND FULL DISCLOSURE: Bengal breeders world wide have in February 2004, initiated global testing of breeding cats for hypertrophic cardiomyopathy (HCM) in attempt to reduce the incidence of future heart disease that has surfaced in the breed. Although Breeder is presently unaware of any carriers of the defective gene that is the primary genetic cause of HCM within the entire history of this cattery, has had no prior known progeny that has developed HCM in the past, and none of the already tested Bengal Exotic FX breeding cats have presented this defect to date, it is hereby disclosed that in addition to one pending case returned here from California awaiting re-evaluation and confirmation of a mild HCM diagnosis, and one recent kitten death specific to HCM, for added surety Breeder is taking further steps to rigorously screen/test all cats on the premises. Screening/testing will continued on an annual basis. Although unforeseen, any occurrence of confirmed HCM beyond our two year health guarantee (for the life of the cat) will be remedied on a case by case basis. Any past purchased Kittens or current Kittens found to have confirmed parentage or recent lineage that is confirmed to have HCM, posing a 50/50 risk of heart defect in that Kitten, owner will be notified. Early detection can prolong the life of the cat even if the defect is expressed moderately or severely as they get older. Breeder hopes to provide periodic screening/testing to local owners at a moderate cost and this clause will be re-written and all prior contracts amended to include that should it become possible.
9. Buyer promises and warrants that the Kitten will be a strictly maintained indoor animal, not allowed to roam freely outdoors. The Kitten will not be confined to any caging for extended periods of time.
10. Under no circumstances will the Kitten ever be sold, leased, placed in or given away to any pet shop, surrendered to any humane shelter, research facility, or similar facility. At any time after taking possession, if for any reason whatsoever this cat cannot be kept by the Buyer, Kitten must be returned to Breeder at Buyer's expense with no refund unless special trial arrangements have been worked out and written herein. This is Breeder’s means of assurance that the acquiring of this Kitten has been well thought out, Buyer has a full commitment for the life of the Kitten, and it is a qualified home placement.
11. Should Buyer ever want to offer Kitten for sale to another party, this can only be done with Breeder’s interview, approval, knowledge, and permission with the stipulations stated herein, understood and agreed to by way of new owner(s) signing this same contract agreement with Breeder.
12. If at any time the cat is found to be malnourished, abused, or neglected, Buyer will surrender the Kitten to Breeder unconditionally with no refund of purchase price to be made. Breeder may from time to time ask to view Kitten to examine growth and development, state of health or ensure its safety and continued ownership.
13. Buyer further warrants that this cat will receive all necessary veterinary care, vaccinations as recommended, adequate high quality carnivore appropriate food, water and grooming, as well as human attention. Buyer, for the entire life of the Kitten is prohibited to have this Kitten declawed as it has been found to be detrimental to this breed, unless danger to owner’s health and thoroughly discussed and agreed to in writing by Breeder. Veterinarians are to be advised of the breed specific adverse reactions to the use of Ketamine as per discussion with Breeder.
14. Buyer/owner ______________ approves, consents and
authorizes Breeder, Wendy Pergentile have on-going access to veterinary records
and have informational discussions with any vet that attends to this Kitten
for the life of the Kitten, including approval for breeder to obtain copies
of any medical records or test results relative to this kitten, and possible
blood or tissue samples in the event of death for further research on cause
of death. This signed contract constitutes as written notification to Buyer’s
veterinary clinic, or veterinarian that this approval, consent and authorization

15. This Kitten is vaccinated against Feline Rhinotracheitis, Panleukopenia
(Feline Distemper) and Calicivirus. Vaccines are given in the right shoulder
at 8 weeks old and again at 12 weeks old. Chlamydia, Feline Leukemia and Rabies
vaccines are not given and are not recommended as the Kitten is an indoor
pet in a family cat household, has come from a cattery that is FeLV/FIV negative
and Breeder experience along with current veterinary vaccine protocols recommend
against Chlamydia vaccine. Rabies is highly recommended should the Kitten
travel to within Canada where rabies is a threat, or as recommended by Buyer's
veterinarian, and is required by law if traveling out of Canada.
16. Feeding and Litter recommendations: High quality food suitable for cats being they are obligate carnivores that can thrive and remain in optimum health throughout their lifetime. Many popular commercial dry foods touted as quality are not, so specific recommendations are as follows: Orijen (Grain Free), Go Natural (Grain Free) Chicken/Turkey/Duck although it has yielded us in very stinky poops; Wellness (blue bag - not seafood), Innova (red bag), Felidae and Natural Balance in dry formulas. Canned foods such as Go Natural, Wellness (Turkey or Chicken), Merrick (Turducken), Innova EVO and Eagle Pack (Chicken or Turkey). Breeder will further discuss addition of some raw diet along with natural treats to increase protein and water content to diet for added health and longivity.
Due to the enjoyment of playing in water, it is recommended not to use clumping litter. Breeder recommends what has locally been found the most economic and least dusty available, namely, Maxx Cat litter.
